1. Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and A to Beyond Ltd, trading as Fuel and Tonic (“we”, “us”, “our”), concerning your access to and use of the Fuel and Tonic website, including any related applications, digital platforms, or services (collectively, the “Site”).
The Site provides the following services:
The marketing, sale and distribution of Fuel and Tonic branded nutritional supplements, wellness products and related goods (the “Services”).
By accessing the Site and/or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
If you do not agree with all of these Terms and Conditions, you must discontinue use of the Site and Services immediately. We recommend that you print or save a copy of these Terms and Conditions for future reference.

1.5 The Site is directed to users residing in the United Kingdom. We make no representation that the content is appropriate or available in other jurisdictions. Accessing the Site from territories where its content is unlawful is prohibited.

Any breach may result in suspension or termination of access.

3.1 You represent and warrant that:
- All information you submit is accurate, current and complete
- You will maintain and update such information
- You are responsible for safeguarding your account credentials
- You have the legal capacity to enter into these Terms
If you suspect unauthorised access to your account, you must notify us immediately.
3.2 We reserve the right to suspend or terminate accounts containing inaccurate, misleading, or inappropriate information.
4. Our Content
4.1 Unless otherwise stated, all content on the Site, including text, graphics, images, designs, logos, software, and databases (“Our Content”), is owned by or licensed to A to Beyond Holdings and protected by intellectual property laws.
4.2 No part of the Site or Our Content may be copied, reproduced, distributed, or exploited for commercial purposes without prior written consent.
4.3 You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for personal, non-commercial purposes only.
4.4 You must not attempt unauthorised access, modification, or interference with the Site or its content.
4.5 We prepare the Site with reasonable care and employ standard security and virus-detection measures, but we cannot guarantee complete security.
4.6 Content on the Site is for general information only and does not constitute medical, nutritional, or professional advice. Always seek advice from a qualified professional before making health-related decisions.
4.7 We make no guarantees that content is accurate, complete, or up to date.
5. Site Management We reserve the right to:
- Monitor the Site for breaches
- Take legal action where necessary
- Remove content that burdens or compromises our systems

We do not guarantee the Site will be secure, uninterrupted, or error-free.

7. Disclaimer and Limitation of Liability

7.2 Liability Limits Nothing in these Terms excludes liability for death, personal injury, fraud, or any matter that cannot be excluded by law.
Our total liability to you shall not exceed the greater of:
- £500, or
- The amount paid by you to us in the six months preceding the claim
Consumer rights under UK law remain unaffected.
8. Term and Termination These Terms remain in force while you use the Site. We may suspend or terminate access at our sole discretion, without notice, for any breach.
You may not create a new account following termination.
9. General
9.1 You consent to electronic communications and acknowledge their legal validity.
9.2 These Terms constitute the entire agreement between you and us.
9.3Failure to enforce any provision does not waive our rights.
We may assign rights and obligations.
No partnership or agency relationship is created.
9.4 Governing Law These Terms are governed by English law, with jurisdiction in the courts of England and Wales (with consumer exceptions for Scotland and Northern Ireland).
9.5 Trademarks All trademarks, brand names, logos, and trade dress associated with Fuel and Tonic are the property of A to Beyond Holdings.
You may not use them without prior written permission.
9.6 No third party has rights to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

10. Online Store, Ecommerce & Shopify Compliance
10.1 Online Store Platform Our online store is hosted on Shopify Inc., which provides us with the ecommerce platform that allows us to sell our products and Services to you. Your data may be stored through Shopify’s data storage, databases, and general Shopify applications. Shopify stores your data on secure servers behind a firewall.
10.2 Product Information & Availability We make every effort to display product descriptions, images, ingredients, pricing, and availability as accurately as possible. However:
- Product images are for illustrative purposes only
- Colours, packaging, and appearance may vary
- Availability is subject to change without notice
We reserve the right to limit quantities, discontinue products, or restrict sales on a case-by-case basis.
10.3 Pricing & Payment All prices are displayed in GBP (£) and include VAT where applicable, unless otherwise stated.
We reserve the right to:
- Correct pricing errors at any time
- Cancel orders placed with incorrect pricing
- Refuse or cancel orders at our sole discretion
Payment must be received in full before dispatch. Shopify-supported payment providers securely process all transactions. We do not store full payment card details.
10.4 Order Acceptance & Confirmation An order is not considered accepted until:
- Payment has been successfully processed, and
- You receive an order confirmation email
We may cancel or refuse an order for reasons including, but not limited to:
- Product unavailability
- Payment authorisation failure
- Suspected fraud or misuse
- Breach of these Terms
If we cancel an order after payment, a full refund will be issued.
10.5 Delivery Delivery times provided at checkout are estimates only and not guaranteed.
We are not responsible for delays caused by:
- Courier issues
- Incorrect delivery information supplied by you
- Events beyond our reasonable control
Risk of loss passes to you upon delivery to the provided address.
10.6 Consumer Right to Cancel (UK Only) If you are a consumer in the UK, you have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
You may cancel your order within 14 days of receiving your goods, without giving any reason.
Exceptions
The right to cancel does not apply to:
- Sealed goods that are not suitable for return due to health or hygiene reasons once unsealed (including opened supplements)
- Perishable goods
- Personalised or custom-made products
10.7 Returns & Refunds Returned items must be:
- Unopened
- Unused
- In original packaging
Refunds will be processed within 14 days of receiving the returned goods or proof of return, using the original payment method.
You are responsible for return shipping costs unless the product is faulty or incorrect.
10.8 Subscriptions & Recurring Orders (If Applicable) If you purchase a subscription:
- You authorise recurring charges at the frequency stated at checkout
- You may pause or cancel subscriptions via your account dashboard or by contacting customer support before the next billing cycle
- No refunds are provided for partially fulfilled subscription periods
We reserve the right to modify subscription pricing with prior notice.
10.9 Promotions, Discounts & Free Products Promotions, discount codes, and free product offers:
- Are subject to availability
- May be withdrawn at any time
- Cannot be combined unless stated
- Have no cash alternative
Orders placed incorrectly or without valid codes may be cancelled.
10.10 Digital Content & Marketing Communications By placing an order, you consent to receive transactional emails related to your purchase.
If you opt in to marketing communications, you may unsubscribe at any time using the link provided in our emails.
10.11 Fraud Prevention We reserve the right to:
- Conduct fraud screening
- Delay or cancel orders flagged by payment processors
- Request additional verification before fulfilling orders
Failure to provide requested verification may result in cancellation and refund.
10.12 Governing Consumer Protections Nothing in these Terms limits your statutory rights under UK consumer law, including rights relating to faulty, misdescribed or unsafe goods.
